Privacy Policy
This policy explains how we collect, use, keep and protect your personal data, and what rights you have over it, in accordance with Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data.
1. The Data Controller
The controller of the personal data covered by this policy is Insta Attestation Services, Instant POA Businessman Services LLC, licensed under licence number [trade licence number — to be completed], of Opal Tower, 8th Floor, Business Bay, Dubai. All data protection matters may be addressed to hello@instaattestation.ae.
2. The Data We Collect
By the nature of our work, the documents you entrust to us contain personal data, and sometimes data of a sensitive character. The data we process falls into the following categories:
2.1 Identity data
- Full name, nationality and date of birth.
- Copies of passports, Emirates ID cards and residence visas.
2.2 The contents of the documents themselves
- Certificates and records of every kind: birth, marriage, divorce and death certificates; educational certificates; good conduct certificates; powers of attorney; and commercial documents.
- Such documents may by their nature contain data about other individuals — spouses, children, business partners — and we afford that data the same protection.
2.3 Contact and transaction data
- Telephone number, email address, and collection and delivery addresses.
- Your correspondence with us by email, WhatsApp or the website forms.
- Payment records. We do not retain your bank card details; electronic payments are processed by a licensed payment services provider.
2.4 Technical data about your visit
- IP address, browser and device type, pages visited and time spent on them.
- These are described in detail in our Cookie Policy.
3. Purposes of Processing and Their Legal Basis
- Performance of our contract with you: submitting documents to the Competent Authorities, following up their procedures, collecting and delivering documents, and corresponding with you about your transaction.
- Compliance with a legal obligation: retaining records and invoices as required by applicable legislation, and responding to requests from competent judicial and regulatory bodies.
- Your consent: sending you marketing messages you have asked to receive; you may withdraw that consent at any time.
- Legitimate interests: improving the quality of our services, securing our website and preventing fraud, in a manner that does not prejudice your fundamental rights and freedoms.
4. Who We Share Your Data With
We do not sell or rent your personal data to anyone, under any circumstances. The nature of the service requires that we share it only as follows:
- The Competent Authorities — this is the very purpose of the service: submitting your document to an embassy, to the Ministry of Foreign Affairs or to a notary public is precisely what you instructed us to do.
- The legal translators we work with, where the service requires translation; they are bound by confidentiality undertakings towards us.
- Approved courier and delivery companies, to the extent needed to collect and deliver the document.
- Technical service providers such as hosting and email providers, to the extent required to operate our systems.
- Judicial and regulatory bodies, where a lawful request is made under the law.
5. Transfers Outside the UAE
Attesting your document may require it to be submitted to a foreign embassy or to an official body outside the UAE. Such a transfer is necessary to perform our contract with you and is made on your instructions. In every such transfer we limit ourselves to the data the transaction requires.
6. Retention Periods
- Original documents: returned to you as soon as the service is complete; we do not retain them.
- Digital copies of documents: kept for as long as needed to evidence completion of the transaction and to address any query arising from it, then securely deleted.
- Accounting records and invoices: for the period prescribed by law.
- Marketing contact data: until you withdraw your consent.
7. Data Security
We apply organisational and technical measures proportionate to the sensitivity of what we handle: access to documents is restricted to those members of our team whose work requires it, paper documents are kept in a secured location within the office, and the website connection is protected by an encryption certificate. That said, no party can guarantee absolute security for data transmitted over the internet.
8. Your Rights Over Your Data
Federal Decree-Law No. 45 of 2021 grants you the following rights:
- The right of access to the data we hold about you, and to obtain a copy of it.
- The right of rectification of data that is inaccurate or incomplete.
- The right of erasure where there is no longer a justification for retaining it, insofar as this does not conflict with a legal obligation binding on us.
- The right to restrict or object to processing in the cases prescribed.
- The right to data portability — to have your data transferred to another controller in a machine-readable format.
- The right to withdraw consent where processing is based on it, without affecting the lawfulness of processing carried out beforehand.
To exercise any of these rights, write to us at hello@instaattestation.ae; we undertake to respond within the period prescribed by law. If our response does not satisfy you, you may lodge a complaint with the competent data protection authority in the UAE.
9. Minors’ Data
We do not provide services directly to minors. Where a transaction involves a minor’s document — a birth certificate or a school certificate, for instance — we deal with the parent or legal guardian, and we assume that the person presenting the document has the capacity to do so.
10. Changes to This Policy
We may update this policy from time to time; the version published on this page applies. Where a change is material and affects your rights, we will notify you by an appropriate means.
